These Standard Terms and Conditions of Sale (“Terms”) govern all sales of goods and services by Galaxy Impex Group Pty Ltd trading as Bulk Deal Australia (“Bulk Deal”, “we”, “us” or “our”) to the customer (“Customer”, “you” or “your”). By placing an order, you agree to be bound by these Terms.
1. ORDERS AND ACCEPTANCE
1.1 All orders are subject to written acceptance by Bulk Deal.
1.2 We reserve the right to decline or cancel any order at our discretion.
1.3 Orders may not be cancelled or amended without our prior written approval.
2. PRICING AND PAYMENT
2.1 All prices are in Australian Dollars (AUD) and exclusive of GST unless otherwise stated.
2.2 Payment terms are as stated on the invoice or order confirmation.
2.3 We reserve the right to adjust pricing due to supplier changes, market conditions, or clerical errors.
3. DELIVERY
3.1 Delivery times are estimates only. We are not liable for delays beyond our control.
3.2 Risk in the goods passes to the Customer upon delivery to the delivery address.
3.3 Additional charges may apply for re-delivery, rural areas, or specific time requests.
4. TITLE AND RETENTION OF OWNERSHIP
4.1 Title to goods remains with Bulk Deal until full payment is received.
4.2 Until title passes, the Customer must keep the goods separate and identifiable.
5. RETURNS, CLAIMS AND CREDITS
5.1 Goods may only be returned with prior written approval and must be in original condition.
5.2 All claims must be made within 7 days of delivery.
5.3 Credits or refunds are at our discretion and may be subject to a restocking fee.
6. WARRANTIES AND LIMITATION OF LIABILITY
6.1 We warrant goods supplied will match the description on the invoice and be of acceptable quality.
6.2 Except as required by law, we exclude all other express or implied warranties.
6.3 Liability is limited to the repair, replacement or refund of the goods supplied.
7. FORCE MAJEURE
7.1 We are not liable for any delay or failure to perform due to events beyond our reasonable control including but not limited to natural disasters, transport delays, pandemics, or supplier issues.
8. GOVERNING LAW
8.1 These Terms are governed by the laws of Queensland, Australia.
8.2 Any disputes shall be submitted to the courts of Queensland.
9. PRIVACY AND CONFIDENTIALITY
9.1 Customer information is collected in accordance with our Privacy Policy and the Australian Privacy Principles.
9.2 We do not disclose customer information without consent except as required by law.
10. GENERAL
10.1 These Terms constitute the entire agreement between the parties.
10.2 Any changes to these Terms must be agreed in writing.
10.3 If any provision is found to be invalid, the remainder shall remain enforceable.
